§ 70-2. Intent and construction.
(a)
Stormwater utility fees collected by the city shall be utilized to improve the public health, safety and welfare by providing for the safe and efficient capture and conveyance of stormwater runoff and for the correction of existing stormwater problems.
(b)
Stormwater utility fees collected by the city shall be used to plan, construct, operate and maintain stormwater management systems as established by the city's stormwater master plan and other local programs pursuant to F.S. § 403.0891(3), and the Code of Federal Regulations with regard to EPA standards.
(c)
Stormwater utility fees collected by the city may also be used to fund the cost of the stormwater management systems and activities as defined in this chapter, and a portion of the stormwater utility fee may be used to fund the billing and collection of fees.
(d)
This chapter shall be liberally construed to protect the public health, safety, and welfare and to effectuate the purposes set forth herein.
(e)
Pursuant to F.S. § 403.0893, any stormwater utility fees imposed by the city may be collected as a non-ad valorem assessment in accordance with F.S. ch. 197.
